Subject: Coverage under the Central Civil Services (Pensions) Rules 1972 in lieu of the National Pension Scheme for those Central Government employees whose selection for recruitment was completed before 1/1/2004 but who entered government service on or after 1/1/2004 are.

The undersigned is advised that as a result of the introduction of the National Pension Scheme (NPS) see Notice from the Ministry of Finance (Ministry of Commerce) No. 5/7/2003 – ECB & PR dated 22.12.2003, all civil servants employed on or after 01.01. In 2004, those appointed to the service of the central government (excluding the armed forces) are covered by this scheme. The Central Civil Services (Pensions) Rules 1972 and other related regulations were also amended pursuant to the 12/30/2003 Notice and following this amendment these regulations will no longer apply to civil servants appointed to the Civil Service after 12/31/2003 became.

2. This department has been contacted since 01/01/2004 by appointed civil servants who have applied for pension insurance under the Central Civil Servants' Code (Pension Code) 1972 on the grounds that their appointment has been delayed due to administrative problems. reasons or process. Similar advice was received from departments/departments seeking advice from that department on whether civil servants appointed on or after 1/1/2004 could also benefit from the CCS pension scheme if their Recruitment delayed beyond 12/31/2003 for administrative reasons and the delay in appointment was beyond the control of said government officials.

3. From the representations of the government officials and the references received from the ministries/departments, it appears that in many of the cases referred to this department the selection process (including written examination, interview and declaration of results) for the recruitment was completed before 01/01/2004 , but the employee entered public service on or after January 1, 2004. Some figures where selection ended before 01/01/2004, but actual unification occurred on or after 01/01/2004 are as follows:

i) The result of the recruitment was announced before 1 January 2004, but the offer of appointment and the official's actual placement were delayed due to police screening, medical examination, etc.;

(ii) Some of the candidates selected through a joint selection process received offers of appointment and were also appointed prior to January 1, 2004, while offers of appointment of other selected candidates were made on January 1, 2004 or later for administrative reasons/constraints, including pending court/ CAT cases.

(iii) The candidates selected by a joint selection process before January 1st, 2004 were assigned to different departments/organizations. While some organizations in Division(s) I completed the recruitment process for one or more candidates on or before 12/31/2003, appointment offers for the candidates assigned to the other divisions/organizations were not made until 01/01/2004 or thereafter.

(iv) Offers of appointment to the selected candidates were made before January 1, 2004, stating that they would start on January 1, 2004.

(v) Offers of appointment were made to selected candidates prior to 01/01/2004 with many/most candidates entering service prior to 01/01/2004. However, some candidates were allowed to extend the entry time and entered service on or after 1/1/2004. However, its age was not affected or reduced in the same batch or in a subsequent batch declared before 01/01/2004.

(vi) The result of recruitment was announced before 01/01/2004 but one or more candidates were declared disqualified on grounds of medical fitness or verification of character and origin, caste or income statements. After an examination, they were then found to be able to work and offers of appointments were made from January 1, 2004.

As the result of the contract was announced before 01.01.2004, in all of the above exemplary cases the refusal to pay pension benefits under the CCS (Pensions) Regulations 1972 to the civil servants concerned is not considered justified.

The matter has been examined in consultation with the Department of Human Resources and Training, the Department of Expenditure and the Department of Legal Affairs in the light of the various representations/references and decisions of the courts in this regard. It has been decided that in all cases where recruitment results were reported before 01/01/2004, as opposed to vacancies that occurred on or before 12/31/2003, the candidates declared the winner of the recruitment, in accordance with the CCS (Pension) Regulations 1972. Consequently, those civil servants declared winners over posts created before 01/01/2004 in the results reported on or before 12/31/2003 and covered by the National Pension Scheme upon entering service on or after 01/01/2004,You may be given a one-off option to be insured under the CCS (Pensions) Rules 1972. This option can be exercised by affected government officials no later than May 31, 2020.

5. Civil servants who have the right to exercise the option under paragraph 4 above but do not exercise it by the scheduled date shall continue to be covered by the national pension scheme.

6. Once exercised, the option is final.

7. It is clarified that the previous option would only be available for those civil servants declared winners before 01/01/2004 against the vacancies corresponding to the period before that date. However, this option is not available to officials appointed after 01/01/2004 if they belong to one of the following categories:

(i) Officials whose names were included in a panel of candidates selected before 01/01/2004 to fill posts which became vacant after 01/01/2004 and consequently were recruited from 01/01/2004.

(ii) A civil servant whose name was included on a panel of selected candidates preparing before 1/1/2004 for posts vacant before and after 1/1/2004 but after 12/31/2003 for a vacancy on or after 1/1/2004 position has been appointed .

(iii) Officials who have been selected for vacancies corresponding to the period prior to 01/01/2004 on the basis of a notice/notification or written examination/interview carried out before 01/01/2004, but whose recruitment results were communicated on or after 01/01/2004.

(iv) Civil servants who joined on 01.01.2004 after having been granted an extension of the induction period at their own request and having had their seniority reduced in accordance with the instructions of the Department of Personnel and Training as a result of said extension. Time of binding to a lot for which the result of the award was announced on or after 01.01.2004.

8. The matter relating to coverage under the CCS (Pensions) Regulations 1972 on the basis of the option exercised by the official will be submitted to the appointing authority for consideration in accordance with these instructions. In the event that the officer satisfies the conditions for coverage under the CCS (Pensions) Rules 1972 in accordance with these instructions, the necessary order to that end will be made no later than September 30th. 2020. The NPS account of these officials will be updated according to w.e.f. closed. November 1, 2020.

9. Officials who avail themselves of the option of transferring to the CCS (Pensions) Regulations 1972 pension scheme are required to join the General Provident Fund (GPF). Regarding the posting of the corpus in the public server SNP account, the Comptroller General of Accounts (CGA) has issued the following clarification vide oficio No. 1(7)(2)/201O/cla./TA III/390 dated 11.14. 2019:

Yo Adjustment of Employee Contribution to Accounts: The amount may be credited to the individual's GPF account and the account may be amended to reflect updated interest (Government FR-16 and Rule 11 of the GPF Rules).

ii. Government Contribution Adjustment under NPS in Accounts: to record as (-) Dr. to object to Header 70 – Deduct Reclaims under Main Header 2071 – Pensions and Other Retirement Benefits – Subheader 911 – Deduct Overpayment Reclaims (GAR 35 and Paragraph 3.1 O of List of main and secondary account managers).

iii. Adjustment for an increase in subscription value due to an increase in the value of investments: may be taken into account by crediting the amount to the government. Account under M.H. 0071- Contribution to pensions and other retirement benefits 800- Other income (note under previous heading in LMMHA).

10. All ministries/departments are asked to publicize these orders widely. The cases of those officials who are investigating in this O.M. and who make use of the possibility of switching to the pension scheme under the CCS rules (pensions) can be decided by the ministries/administrations according to these orders.

11. These orders are issued with the approval of the Ministry of Finance, Department of Expenditure, vide su l.D. Note No. 1(7) EV/2019 of 01/08/2020.

12. In their application to the staff of the Department of Accounts and Audit of India, these Orders are issued after consultation with the Comptroller and Auditor General of India in accordance with Article 148(5) of the Constitution.
